Beazer Homes and Beazer Home Mortgage

The attorneys at McGowan Hood & Felder, LLC, have recently filed a lawsuit seeking class action status in the United States District Court, Columbia Division.  This lawsuit is one of the first federal lawsuits in the country against Beazer Homes and Beazer Home Mortgage.  The suit alleges, among other things, that Beazer Home and Beazer Home Mortgage worked together to attract people who would otherwise be unable to afford the monthly mortgage payments for a home in a Beazer neighborhood.

In order to get these “unqualified” homebuyers approved for a mortgage, the suit alleges that Beazer Homes and Beazer Home Mortgage would assist the potential purchaser in producing untruthful and/or inaccurate mortgage applications.  Based upon these false representations, the homebuyers would be approved and were able to “purchase” a Beazer home.  As these “homebuyers” were in fact unable to afford the mortgage payment they eventually went into foreclosure.  When there are an abnormal amount of foreclosures in a particular neighborhood or development, the surrounding homes will naturally, and unfortunately, lose a substantial amount of their value.

If you live in a Beazer neighborhood your home may have lost value due to these foreclosures.  Even if you sold your house, you may have been entitled to sell it for more.  If you believe your house should have sold for a higher amount, you may be entitled to damages from Beazer for suppressing the natural growth in value of your home.
